• preparation of land for sale;
• conducting a land auction or drawing up a purchase and sale agreement;
• securing ownership rights to the plot.
The buyer must submit an application to the city or village administration. The application must specify the desired size, location, and intended purpose of the land. If there is more than one buyer, a list of buyers and the share of each must be indicated. The application is subject to registration in the established manner.
The application must be accompanied by:
• identity documents (for individuals);
• constituent documents and certificate of state registration (for legal entities);
• state act on the right to use or lease agreement for the land plot;
• plan of the plot;
• copies of documents confirming ownership of all structures located on the plot (if any).
A negative decision by the administration can be appealed in court. The applicant may be refused the acquisition of the plot in the following cases:
• the applicant is a legal entity against which bankruptcy proceedings have been initiated;
• the land is not subject to privatization;
• the applicant is not entitled to acquire this plot under the legislation of Ukraine;
• the applicant has not submitted all necessary documents;
• discrepancies have been found in the applicant's documents.
In case of approval by the administration, the seller must, within 30 days, identify all restrictions on the use of the plot, develop a land allocation project, and coordinate boundaries with neighboring landowners. If the seller wishes to sell the land plot at auction, the applicant must be informed about this.
If the seller does not intend to put the land up for auction, he concludes a purchase and sale agreement with the buyer. The agreement is concluded in writing and is subject to mandatory notarization at the location of the plot with payment of state duty. Mandatory clauses of the agreement:
• subject of the agreement (size, location, intended purpose and mode of use of the plot);
• restrictions on the use of the land plot;
• price of the plot and payment terms;
• rights and obligations of the parties;
• other clauses (at the discretion of the parties).
After signing and notarization of the agreement, any other agreements on land use concluded earlier lose their force.
