The Duldung status means a temporary suspension of the deportation of a foreigner from Germany
The author of the initiative – Interior Minister Nancy Faeser from the SPD party – believes that the initiative meets the conditions of the coalition agreement on migration issues. In her opinion, it is also necessary to improve conditions for the immigration of skilled workers and speed up the procedure for forced removal of persons who do not have the right to stay in the country. According to the publication "Redaktion Germany", the corresponding bill is planned to be prepared in the summer.
If the innovation regarding migrants with the status of "deferred deportation" is adopted, it will affect about 100,000 people across the country. Among the requirements put forward are commitment to the democratic principles of the state, as well as to the legal and social order of Germany. Criminals, as well as those who try to mislead officials by providing false information about themselves, will be deprived of the opportunity to stay in the country on this basis.
At the same time, providing an identity document and proof of income can be done later – one year after obtaining the status. After that, migrants will even be able to obtain permanent residence in Germany. The status itself – "Chance – right to stay" – is temporary and, according to the initiative, should be limited to two years. In addition, persons who do not apply for the new status but meet all the stated requirements will be able to obtain a residence permit on an accelerated basis – after 6 years instead of eight.
According to supporters of the initiative, the current situation is such that integrated migrants, as well as people who speak German and abide by the law, are subject to forced removal from the country. At the same time, it is not easy to get rid of offenders. According to opponents, the new law will open up opportunities for legal stay in the country for those migrants who evade the obligation to leave Germany.
This bill is also criticized for appearing too late. Until the law is adopted, migrants who meet these criteria can still be deported. When exactly the legal act will be adopted is currently unknown.
