If they promise hassle-free import of medical equipment, be wary
Technically, it is possible to obtain medical equipment and arrange import of medical equipment (of any purpose) legally, without customs duties and additional taxes. In Ukraine, as in European countries, these options exist: Supply within the framework of humanitarian aid; Provision of equipment to save patients' lives; Temporary transfer of expensive equipment with guarantees of return.
There are a few more situations where customs clearance will be easier, but these are specific, rare cases. In the vast majority, everything related to medicine will be literally examined under a microscope.
One can discuss double standards, humanitarian cooperation, and other details, but all discussions end at the level of legal nuances of the signed contract.
And here you cannot do without the help of a competent and experienced lawyer with relevant experience. You can calculate the losses yourself: if there are suspicions, the cargo will be sent to the category of 'physical evidence'. And given the situation, Ukrainian law enforcement agencies do not consider such cases a priority.
Why chase imaginary benefits in such conditions when everything can be done legally, lawfully, and even receive compensation?
Not all medical equipment gets customs approval
One of the unresolved problems is the system of mutual certification of pharmacological drugs, life support systems, methods and principles of resuscitation. While doctors cannot agree among themselves, lawyers face many problems related to the crossing of borders of certain equipment.
Commercial intermediaries look for loopholes and opportunities to save on logistics, fraudsters simply spin a yarn, receiving advances and disappearing. As a result, medical institutions, and most importantly, patients, suffer from a shortage of medical equipment.
The current situation is not easy to resolve with a couple of laws. It is impossible to issue a decree that if medical equipment is being shipped, customs should step aside. The cargo may get stuck on the other side of the border as well. This is a factor that intermediaries will definitely keep silent about, and in case of such an 'arrest', they will step aside, avoiding any, even financial, responsibility. Even with a signed contract, it will be impossible to get the prepayment back – force majeure. Look at the offer and you will see in the force majeure clause many opportunities for the counterparty to evade fulfilling obligations.
Why then fall for false promises associated with a large number of technical restrictions? Look for companies ready to provide legal support for any transaction with medical equipment up to the stage of inclusion in the clinic. There are few such companies, but we assure you, they exist.
