However, our compatriots have not yet grasped that Russia is already a foreign country where foreign citizens require temporary registration. And even less do they think that this foreign country passes laws regarding foreign citizens.
Issues of employment of foreign citizens are regulated by the law "On the Legal Status of Foreign Citizens in the Russian Federation". In accordance with it, foreigners may temporarily stay or permanently reside in Russia.
A foreigner temporarily staying in the Russian Federation may take up employment or conclude a civil law contract only if he has a work permit (Article 13 of the RF law). The work permit is issued to the employer or the customer of works (services) for each foreign worker, provided that the former makes, in accordance with the established procedure, the payments necessary to ensure the departure of each foreign worker from the Russian Federation by appropriate means of transport (Article 18 of Russian Government Regulation No. 941).
The employer may be a Russian organization or an individual entrepreneur. The employer submits an application for a permit to hire foreign labor to the territorial internal affairs body on a form of the established format.
Special documents issued in the territories of foreign states, copies of which are submitted for a citizen to obtain a work permit, must be legalized in the established order at diplomatic missions or consular institutions of the Russian Federation abroad. If the documents are drawn up in a foreign language (in particular, Ukrainian), a notarized translation into Russian is attached to them.
A separate decision is made on each application. The work permit contains information about the owner (full name, date of birth, citizenship or state of permanent citizenship (primary residence), information about the period of employment or entrepreneurial activity, and other information if necessary. A color photograph of the foreign citizen is placed on the work permit.
The work permit is issued on a form with multi-level protection against counterfeiting and made in the form of a standard-sized plastic card. This permit is a document of strict accountability; its form is approved by the Ministry of Internal Affairs of the Russian Federation.
The work permit is signed by the head of the territorial internal affairs body that made the decision to issue the work permit, or by an authorized representative (official), and is sealed with the seal of that body. A state fee in the amount of 1,000 rubles is charged for issuing a work permit (clause 9, item 7, article 4 of the Russian Federation Law "On State Duty").
The employer or customer of works (services), including a foreign citizen registered in the Russian Federation as an individual entrepreneur and acting as an employer or customer of works (services), is obliged to transfer the work permit to the foreign worker in whose name it is issued before the start of his labor activity in the territory of Russia.
Foreign citizens have the right to participate in labor relations in the territory of Russia, provided that they and their employers comply with all formalities established by law and regulations.
In accordance with Article 13 of the Russian Federation Law, the employer for foreigners may be a natural or legal person that has obtained, in the established order, a permit to attract and use foreign workers and uses their labor on the basis of employment contracts concluded with them.
A permit to attract and use foreign workers is issued by the federal internal affairs body or its territorial bodies upon the conclusion of the corresponding territorial body dealing with employment issues. A state fee of 3 thousand rubles is charged for issuing a permit to attract and use foreign workers.
As determined by Presidential Decree No. 2146, the permit is issued, as a rule, for a period of up to one year. At the reasoned request of the employer, the validity of the permit after its expiration may be extended, but by no more than one year. When extending the validity of the permit, the same fee is charged from the employer.
