As Ukrainska Pravda reports, this is stated in a joint letter from Minister of Justice Mykola Onyshchuk and Head of the State Border Guard Service Mykola Lytvyn regarding the introduction of a unified procedure for state enforcement officers to apply certain norms of current legislation. The letter was issued with the aim of interagency regulation of the current procedure for travel abroad of persons who have unfulfilled obligations, including alimony payments.
Current legislation, in particular the Law 'On the Procedure for Exit from Ukraine and Entry into Ukraine of Citizens of Ukraine' and the Law 'On the Legal Status of Foreigners and Stateless Persons', establishes that the existence of unfulfilled obligations imposed on a person by a court decision is grounds for restricting their right to travel outside Ukraine.
As noted in the letter, the issue of such a restriction, in accordance with legal requirements, will be resolved in court. In particular, the preparation and submission of motions to the court will be carried out by state enforcement officers in the manner prescribed by the provisions of the Civil Procedure Code of Ukraine. The motion regarding the restriction of a person's right to travel outside Ukraine will be prepared by the relevant departments of the state enforcement service.
After receiving a court ruling on temporary restriction of a person (debtor) from traveling outside Ukraine until they fulfill their obligations, the state enforcement officer will, the next day, send a certified copy of the ruling to the Administration of the State Border Guard Service of Ukraine for execution.
It should be noted that in Russia, bailiffs have long blocked debtors' ability to travel abroad. As reported by «Правда Волгограда», you can check the existence of a ruling restricting exit from the Russian Federation, which is especially relevant on the eve of the summer vacation season, at meetings with bailiffs that are even held in supermarkets. And this is relevant - because last year alone, almost 20 thousand citizens were unable to leave the country. And since February 1, 2008, a new version of the law 'On Enforcement Proceedings' came into force in the Russian Federation, according to which the Federal Bailiff Service (FSSP) can prevent citizens who have debts to banks, alimony defaulters, and even those who have overdue GIBDD fines or utility bills from traveling abroad.
